bitfarm Informationssysteme GmbH – Privacy Policy (mobile-App)

Protection and security of personal data are a high priority for our company. Thus, collection, storage and usage of said personal information only happens strictly according to the regulations of valid data protection laws. In the following, we provide you with information regarding the processing of your personal data within the context of the use of our application (hereafter referred to as 'app').

2. Collection, processing, storage and usage of data

Every time the app is utilized, our server automatically collects log file data which are internally saved and transmitted from the app to the server. This either happens permanently (only if the function 'activate debug logging' is switched on via 'advanced settings') or if an application error occurs. The following data may be collected (depending on the settings mentioned above):

Every data the app sends to its equivalent app server, are subject to data protection of this server’s operator. The responsible authority is always the respective network operator, provider or system administrator. bitfarm GmbH does not have any access to the server(s) of the particular operator except at their explicit request (e.g. for support / maintenance issues).

Data that is saved in a log file also will not be transmitted to or stored on bitfarm GmbH servers. This means that no data regarding users‘ interests or usage behavior will be processed, neither anonymised nor personalized. Likewise, an evaluation of usage data to create personal usage profiles will not be carried out. Furthermore, bitfarm GmbH will not gain access to any of the data mentioned above, neither automatically nor 'for technical reasons'. In addition, neither the app nor bitfarm will record any technical data regarding the users‘ hardware or the network operator (e.g. IMEI, UDID, IMSI, SIM, location data).

Data collection and processing of the application take place in accordance with German and European data protection directives. Pursuant to the principle of data economy, only data that is essential to provide functions of the app or to allow error analysis will be collected and processed.

3. Legal basis for data processing

To be able to offer you our app and the relating services, personalised data will be processed on the following legal basis:

In relation to the respective type of processing, we will refer to the appropriate terms so that you are able to see on which basis we will process personalised data. If personalised data is processed on the basis of your consent, you have the right to revoke this with future effect at any time. If data is processed on the basis of legitimate interests, you have the right to object to the processing of personalised data (under the consideration of the legal requirements of Art. 21 GDPR).

4. Data transferring / recipient

Any data that you provide us with will not be transferred to a third party, neither for commercial nor non-commerical use.

Should any data be processed outside of the EU, the respective information could be taken from the aforementioned paragraphs.

6. Use of Cookies

Our app uses so-called 'session cookies' for purposes of identifying the user of the bitfarm-Archiv system. Cookies are small text files that will be put down on your device and saved by your browser. These cookies do not retrieve any personal information from your hard drive; neither do they compromise your device or any of the data saved on it. In fact, most browsers are configured to automatically accept cookies. You can switch to your browser’s settings if you want to generally refuse cookies, disable or delete them. Alternatively, you can set your browser to ask before setting a cookie. Unfortunately, if the Android / iOS app is utlized, these possibilities do not exist. In any case, every cookie set by us will be deleted from your computer after each session.

7. Use of personal data

Personal data will only be collected or processed if you voluntarily give it to us, e.g. in line with making an enquiry. By making use of all available technical and organizational measures, any personal data that are provided to us will be secured so that they are not accessible for third parties. Nevertheless, if you want to send sensitive data or information, we recommend to do so by mail. Complete data security cannot be guaranteed if you choose to send data via e-mail.

8. Rights of access, rectification, blocking and deletion of data

WUpon request, we will inform you about any of your personal data we have saved, about their origin and recipient, as well as the purpose of storage, all according to Art. 15 GDPR (Right of access by the data subject). You can get these information by contacting us.

9. Rights of objection and revocation

You have the right to object, on grounds relating to your particular situation, at any time to processing of personal data, e.g. by revoking the creation of usage profiles. In this case, we will refrain from processing your data for such purposes. An objection or revocation can be informally – and without giving reasons – sent to us via mail, phone, fax or e-mail:

10. Changes to this policy

This policy will be updated from time to time to protect your personal data. Therefore we recommend that you occassionally reread it. By doing so, you will be up-to-date on how we protect your data and improve the content of our app. Should any siginificant changes regarding the collection and processing of your personal data be made, we will inform you by easily visible references in the application. By using the app, you agree to the terms and conditions of this privacy policy.

11. Right to appeal to the authorities

Notwithstanding any other administrative or judicial decision, you have the right to appeal to the authorities, especially in the member state where you are located, your workplace, or the location of the alleged violation if you believe that the processing of your personal data is in violation of GDPR. The authority receiving the appeal shall inform the appealing party of the status and result of the appeal, including the option for a legal decision as per Art. 78 GDPR.
